I. Presentation

The website www.chevalblanc.com (otherwise known as the "Site"), is published by LVMH Hotel Management (hereafter "LVMH HM"), a company organized and existing under the laws of France, registered under n°501 672 794 RCS Nanterre, with a share capital of 300 000 euro, whose registered office is located at 24-32 rue Jean Goujon, 75008 Paris, France ; VAT number FR 53 501672794 ; email mktg@chevalblanc.com ; phone numer 01 44 13 22 95.

The use of the Site will be subject to the terms and conditions described below (hereafter the "Terms and Conditions"), whose purpose is to define the terms of access and use of the Site by any person (hereafter the "User").

The Site presents hotel and catering services provided by LVMH HM, and in particular offers Users the possibility to address online enquiries and book a Cheval Blanc hotel reservation.

II. Intellectual Property

The Site and any content featured or displayed on the Site, including, but not limited to, text, graphics, photographs, images, moving images, sound, illustrations, data, files, trademarks, designs and models, as well as any software used in connection with the Site (hereafter the "Content") contain confidential information or information protected by existing intellectual property right legislation or any other law.

Unless specified otherwise, intellectual property rights relating to such Content are the exclusive property of LVMH HM. LVMH HM does not grant any license nor any other right except for the right to access and use the Site

The reproduction of all or any part of the Content is authorized solely for personal and private use. Any and all reproduction and use of copies of the Content for other purposes are explicitly forbidden.

Users may not copy, modify, create a derived work, reverse engineer, decompile, disassemble, grant, sublicense or transfer, in any way what so ever, any and all element of the Content or the Site.

III. Personal Data

LVMH HM collects and process Users’ personal data in conformity with French Law n°78-17 of 6 January 1978 (as amended) and European regulation regarding personal data protection.

LVMH HM invites Users to consult its Data Protection Policy, which sets out the provisions governing the collection, processing and transfer of personal data.

1. Limitation of liability

LVMH HM commits itself to ensuring, to the best of its ability, that the information posted on this Site is correct and up-to-date. LVMH HM reserves the right to correct, at any time and without prior notice, the Content of the Site. However, LVMH HM cannot guarantee the correctness, precision, thoroughness or completeness of the Content available on the Site and encourages Users to contact LVMH HM directly.

LVMH HM does not control all risks related to the use of the Internet, and draws the User’s attention to the potential risks involved by the use of the Site.

LVMH HM shall not be held liable for:

- any Site interruption;

- any bugs, display errors or error downloading the web pages of the Site;

- any errors or omissions contained in the Content available on the Site;

- any and all damage resulting from a third party’s fraudulent intrusion;

- any direct or indirect damage, whatever its cause, nature, origins or consequences, resulting from the access to the Site or any Content coming directly or indirectly from the Site.

2. Hypertext links

The Site may include links to other websites or other Internet sources. LVMH HM cannot control these sites and external sources. Therefore, LVMH HM shall not be held liable for those sites and external sources and declines any responsibility for the content, advertising, products, services and any other material available on or branching off those sites and external sources. In addition, LVMH HM shall not be held liable for any damage or losses, true or alleged, deriving from the use or from having trusted the content, or goods and services available on those sites or external sources.

LVMH HM reserves the right to modify and update, at any time, the Terms and Conditions and/or the Content of the Site.

When accessing the Site, Users shall be deemed to have accepted without reserve the Terms and Conditions and the Data Protection Policy.

2. Applicable law and jurisdiction

The Terms and Conditions are governed by French law.

To the extent permitted under applicable mandatory law, any and all disputes arising from the Content or the use of the Site shall be subject to the exclusive jurisdiction of French courts.
